Lawyers' Update

Suede is extremely proud and happy to present an update regarding the lawyers who are dealing with the cases of illegal dismissal of HCT staff and faculty. This was added as a comment to a posting several days ago, but I feel that it deserves a more prominent billing.

An update from the lawyers. I stopped in this evening to discuss my case. I’ve been told a number of HCT employees (even some from ZU) have taken advantage of the free consultation and were able to return to HCT HR and get more money than they were previously offered. So, in short a Free Consult leads to More Money! That’s not bad at all, and these guys are happy to do it even if the consults don’t result in cases. All employees are advised to bring their contracts, though. So much for the claim that these lawyers just want to take advantage of HCT victims.

Another thing is that any employees who left under the following conditions IN THE PAST have a case that can be won:

1) Terminated without severance pay equal to their full monthly salary for three (staff) to six (faculty) months.
2) Employees who worked out their contracts and only got paid to their last work day in June. They should have received full salary through their contract date, which is why HCT is now changing contracts to start and finish in July.
3) Employees who resigned and gave the required notice period and were then charged a penalty because they did not resign at the end of a semester. 
4) Employees who declined to sign the new contract and were terminated.
5) Employees who were not offered a new contract and were not officially notified of their non renewal must be renewed or given severance.
6) Employees who were officially offered a job and had the offer withdrawn.

IF HCT TELLS YOU TO SIGN THE NEW CONTRACT OR RESIGN, OR THAT A REFUSAL IS EQUAL TO RESIGNATION, DONT RESIGN!

DON’T RESIGN! THEY HAVE TO TERMINATE YOU OR EXTEND YOUR CONTRACT AS IT IS. 

Another positive thing is that if an employee does not want to sign the new contract, they don’t have to, no matter what HR tells them. If they tell you to sign it or resign, don’t resign. If they terminate you, you must get the complete severance package. For example, a teacher who refuses to sign the new contract in June or May, or any other month, and is terminated, must receive the full six months of severance payments from the date they receive official notice of termination or non renewal of the contract. If an employee refuses to sign the new contract and HCT chooses to renew that person’s contract, it must be under the old contractual terms and not the new ones.

So, you may be asking yourselves just why HCT HR has a different story. Well, the answer is they don’t know about the law and don’t care. It’s not that they are right – they are ignorant, and wilfully so.

Keep that in mind when HR tells you anything; they could be completely wrong and not even know it.

You don’t resign. Tell them the law is on your side or delay delay delay — and then tell them. In order for you to resign you have to put it in writing. It’s not automatic. There was a foolish sand-brained arrogant HR piss ant who told me that if I did not accept their end of service offer they would cancel my visa. I took that email down to the immigration disputes department. That guy lost his job. The law is on our side. And if you were ripped off, visit the lawyers on the fifth floor of the Herfy building near Al Noor Hospital on Khalifa Street and get your free consult. By the way, if you did not officially resign in writing then you didn’t resign. In such a case it could be argued they terminated you and that gets you at least severance. When is HCT going to start treating their employees with a little respect!

Hi Guys,
Great News Suede!

I am an Ex-HCT Faculty employee who suffered the most humiliating dismissal ever experienced. My contract was terminated just over one year into a supposedly three and half contract. I was dismissed for no reason and forced to take three months pay and leave the college. My kids were still schooling and I could not leave the country in order to allow them to take SATs Primary exams three months away.I stayed in the UAE, and in the meantime I tried to mount a law suit against HCT but I couldn't continue as I ran out of Visa time .
I still have the contract and dismissal letter with the lawyer report of the whole claim.
Can I pursue the case in the light of the info from Suede Oasis under Lawyers update Wrongful Dismissal published on the 7th of October 2017.
If so how would I go about it. Can I engage a Lawyer in UK.
Your advice is very much appreciated. I am determined to get my rights from them.

I think you can pursue but I doubt a UK layer would know what to do unless you want him to work with the lawyers in Abu Dhabi. SO has their contact information.

Does anybody have any news on the Taleb Obaid exam-cheating scandal? It sure needs some further exposure!

I can't remember the idiot's name in central - someone the new, more corrupt VC brought in. Anyway, under the VC's direction, all final grades were 'normalized' which meant students that had F marks were now Cs. Apparently the engineering class he was pretending to teach all failed...until grades were normalized.

If the Emiratis don't care what goes on in their own country, how can anyone else.

The former Director for ADWC, Adel Al Amri. Is he still stinking up the place? Said he received his degrees from the US but could barely speak English let alone write it. Big dumb bull who caused more anxiety for all his teachers for nothing. Would roam the halls looking for teachers that were late to class to yell at. Was awarded the Giant Turd of a Human award every month.

This camel dung place is Sheikhdom and what the head turbaned guy who rules there says goes. This is not a democracy to get recourse through law. These teachers must have been desperate to seek jobs there and when you do that in a camel racing place, you are doomed. Get a life and put it to experience.

Yes, They steal the government money. They conspire among each other and if someone blows the whistle, they simply fire them. All the very high management are all involved and they all want to keep their money supplied to their pockets without having the least interest about education! the new VC is corrupt. all the immediate reporting individuals to him are the most corrupt in the UAE and I lived in that country for over 20 years. I've never seen that much stealing from a federal government. The people who are responsible to report these breaches care only about one thing: their image and money. NOTHING ELSE. If you would like to corrupt your professional career join them. So many scandals. a culture that nurture corrupt lazy individuals and fires all the whistle blowers and the honest people with dignity. You can stay there as much as you want as long as you ignore all the thefts and corruption. Just keep your head very low and sell your morale to the thieves. the law to them is a joke. Best practices and audit is an image that needs to be clean on the outside but is willing to sell their mother on the inside. No benefits whatsoever other than the money and the salary is not that competitive. For them, they have infinite supply of money but only for the gang members. the honest ones are humiliated, intimidated and fired because simply the culture of corruption and stealing doesn't afford the honest people presence. DO NOT WORK FOR THEM. STAY AWAY FROM THEM. FIND ANY OTHER COMPANY IN UAE OTHER THAN THEM.
