Illegal Breach of Contract

Recent intelligence reports from one of Suede’s inside contacts reveal some extremely unpalatable news about the new contracts that were imposed on continuing HCT inmates earlier this month. Please read the following if you were one of those who were severely humiliated several weeks ago.

Firstly, it has been confirmed that all continuing employees had to sign and approve the contractual changes or be summarily dismissed, i.e. terminated without cause. This move was taken by the HCT management to promote increasing loyalty and deference amongst the remaining inmates.

The second point is already common knowledge, namely that all existing education allowances have been reduced by half. As a result, many HCT staff with children will now only send them to school part time, or will merely be developing one side of the brain instead of both (as per HCT Emirati management).

Thirdly, a large number of employees were given summary termination notices, thus making June 30 their last day of work. The three-week notice period is designed to enable them to take a lengthy summer break, perhaps even extending into January 2018, as they find it impossible to find new jobs in such a short period of time.

Finally, there has been absolutely no evidence of consistency from employee to employee in the benefits provided by the new contracts. For some, it sucks big time: for a chosen few, it just sucks, period.

Now here’s the interesting bit regarding the above. The law is very clear on terminating contracts, and summary termination is illegal unless full severance pay is given. Teachers must therefore be given six months full salary from the date they were notified of termination, which was around June 1. Full salary for six months could be around DH180,000. Regular staff should get three months.

For me it would have been a DH 234,000 loss. That is a LOT of money to just walk away from. The option for these employees is to hire my lawyer. Because of my cases, my lawyer has a legal history to use to help win other cases. After they do that and give him a POA, they can leave the country if they wish. Plus, they can do it without cancelling their HCT visa and risk being declared an absconder. My lawyer can file a case against HCT with immigration so they would be blocked from filing an absconding case. By leaving their visa uncancelled, they will get HCT in big trouble with immigration, as they did in my case.

In short, leaving HCT without getting the due severance settlement would be extremely foolish. Please tell everyone that they can sue HCT and still leave the country, as long as they have given the lawyer a power of attorney before they go.

Agent Z is right. I myself stand to lose more than 200K in dirhams if pirate Zak gets his way, so I am standing up and preparing for a fight. If we all do the same, he'll end up a battered mess!

I wish I had done that last year. They gave me my contract renewal in June, and it sucked, so I refused it. They turned around and said I should give them 6 month notice, and took away 120k from my severance pay. I didn't know I could hire an attorney and leave the country (I didn't want to miss a job elsewhere). But I never forgot the way they treated me near the end. After years of service and good reviews. They have absolutely no loyalty. They're ready to rip into anyone for their personal gain.

No. You were fired. You can still get that money they stole from you. Get the lawyer details from Suede. That's way too much money to walk away from and they probably deducted from your settlement as well. But you have to be quick. There is a time limit.

What's the time limit? I was terminated aummer 2013 while away on annual leave. When i got back they refuaed to give my an EOS. That cane from senthi, khan and kamali.

I think that hct employees are all complaints and no action.

Even those who have contact the lawyers who can win their EOS cases have not taken the necessary step of actually meeting with the lawyers. Interesting.

Even if an employee was ripped off by hct two and three years ago, these lawyers can open up a case to get the right amount of compensation. And what is this I hear about teachers getting fired for not signing the new contract and not getting six month severance? This is completely illegal and exiting employees just take the amount hct gives them. Anyone who is not willing to put an effort into getting the end of service they are required to receive are only getting what they deserve when they just go ahead and takes what ever treatment hct gives them. Suede Owasis has the lawyer contact info and knows which of the two to contact first.

Are you out of the UAE? You can still get your money. Arranging a power of attorney is more of a hassle of course but that should not stop you. The reason why hct continues to rip people off is because hct employees allow them to do so.

Of course you may care to enhance this caricature by noting that most hct faculty have such left wing biases that they have no way of comprehending their own predicament such is their dependency on employer control of their affairs. Too funny, too funny.

In answer to Anonymous who asked about a time limit, it would be better to contact SO for the lawyer contact info and ask them, I understand they have this thing about meeting people face to face so baring that you might have to put your details in writing. Be concise. The last I heard, there is still hope for employees who left a few years ago.

If you are considering working for HCT in the UAE, you must firstly remember where you are. You have to be very careful what you say and definitely never put anything in writing. There is an extreme culture of fear and a total lack of transparency in the college culture. Even though the lower management and your line manager may be nice enough on a daily basis, they will never make suggestions, voice faculty opinions in meetings, or support staff in any way for fear of loosing their jobs. Staff are dismissed without warning and no reason is ever given - there is no job security and no respect for faculty or admin staff.

Secondly, if you are any kind of educational professional, then you must remember to leave your standards behind. This can be difficult at first and will cause problems. The Emirati students may be friendly enough and easy going, but they are not particularly hard working or studious. They expect full marks for everything and want to come and go as they please. if this does not happen, they will resort to bullying and intimidation, and will complain about you in an attempt to get you sacked. Remember they are the locals and have the power - not you. It is a sharp leaning curve when you first arrive.

Courses and the curriculum change all the time, sometimes mid-semester! Everything is always for a quick fix, or for someone higher up to make some money out of the colleges. It's never anything to do with teaching or learning, and it never takes place with any consultation.

So, although as in most places of work you will meet some great colleagues, the working environment overall is completely toxic! My advice is therefore to stay well clear; there is more to life than money!

Your well-known inability to accept rejection from an employee play well into my hand and magically increased my EOS by six months. You got played, fools, and topped off my son's college fund.

You think that you harmed me? You did EXACTLY as I expected you would and awarded me with the "Ka-ching" settlement that so many here pine for! Thank you for your vanity and predictability!

Yes, HCT high management steal the government money. They conspire among each other and if someone blows the whistle, they simply fire them. All the very high management are all involved and they all want to keep their money supplied to their pockets without having the least interest about education! the new VC Abdullatif AlShamsi is corrupt. all the immediate reporting individuals to him are the most corrupt in the UAE and I lived in that country for over 20 years. I've never seen that much stealing from a federal government. The people who are responsible to report these breaches care only about one thing: their image and money. NOTHING ELSE. If you would like to corrupt your professional career, join them. So many scandals. a culture that nurtures corrupt, lazy individuals and fires all the whistle blowers and the honest people with dignity. You can stay there as much as you want as long as you ignore all the thefts and corruption. Just keep your head very low and sell your morale to the thieves. the law to them is a joke. Best practices and audit to them is an image that needs to be clean on the outside but is willing to sell their mother on the inside. No benefits whatsoever other than the money and the salary is not that competitive. For them, they have infinite supply of money but only for the gang members. the honest ones are humiliated, intimidated and fired because simply the culture of corruption and stealing doesn't afford the honest people presence. DO NOT WORK FOR THEM. STAY AWAY FROM THEM. FIND ANY OTHER COMPANY IN UAE OTHER THAN THEM.
Corrupt individuals:
Abdullatif AlShamsi the VC (they are doing their best to have an honest person) – He is the head of the gang of thieves.
Abdul Aziz Al Raisi Human Resource (if he’s in another country he should be in prison by now)
Khulood Al Mualla (connections are the only thing that kept her alive in the company)
All the good people couldn’t survive, either ran away or their were fired.
All the high management reporting directly to Abdullatif AlShamsi are corrupt.
