Start the Paper Chase!

SuedeO is once again privileged to be able to provide some extremely important information for HCT Faculty and staff who may be finishing their last semester. Once more I am indebted to Agent X in HCT central services for the following words of wisdom, which indicate that many of the higher management goons (such as the arch thief Taleb Obaid, pictured alongside) have been trying to follow as closely as possible the progress of current lawsuits against the HCT over end of service pay outs.

Just by way of reminder, these lawsuits are calling into question current HCT practices that are the result of policy, but are on shaky ground legally – are plainly illegal, in other words. Agent X has helpfully provided the following advice about documents that need to be collected by ALL departing employees in the period leading up to their exiting HCT.

Collect the following:

1) Any documents that can verify the starting date at HCT, and contract renewal letters/offers. 
2) Any documents that contradict each other regarding employment, such as copies of both contract renewal and termination within several months of each other.
(Employees who were both extended and terminated in previous years have grounds to sue for all the money they would have earned during the renewed contract)
3) Random pay stubs from the years of working for HCT, especially the final one.
4) Any documents from HCT containing any end of service settlement offer.
5) Any documents that express termination and/or give a last day of work. 
6) Copies of any emails to and responses from central service regarding any end of service enquiries.
7) A PDF copy of the HCT academic calendar for the last academic year of employment.
8) A document that shows you as faculty or staff.
9) Any emails from HCT or management regarding employee benefits and end of service, leave days, etc.
10) A copy of the 2013 decree from FAHR.gov.ae
11) Any other email that might be helpful in the future.

This list is not exhaustive as yet, and there may be more posted later in the comments section.

Incidentally, all new employees should find the obscurely located HCT policies and procedures on the portal and print it out or save it as PDF in its entirety, since legally HCT considers that as part of your contract, and it will be the only version that applies to your initial employment arrangement with HCT.

Furthermore, all HCT employees are encouraged to get the word out and make sure the above is common knowledge. If anyone feels they should be getting more, they can contact SuedeO for the contact information for one particular lawyer who is becoming highly versed in the applicable laws. Depending upon how long a person has been working for HCT, the difference between the law and HCT policy could well be hundreds of thousands of dirhams!

Advise all who wish to contact the legal team that the lawyer has a heavy case loan, partially because of new hct related cases. The best course is to communicate persistently until you get a response. The lawyer does not like to discuss cases over the phone so you will need to stop by his office in the late afternoon/evening. His office is easy to find. It is the only legal firm on floor 5 of the Herfy building on Khalifa Street, Abu Dhabi. If you live outside Abu Dhabi, tell him that since he does make some trips to Dubai but mostly that is for ongoing cases. I've suggested to him that he try meeting people by skype but that is a planet he is hesitant to visit.

Just don't be sirprised if you have trouble getting a response. It's not that he is not interested since I assure you with great confidence that he is. Be persistent.

My guess is that he will need to take on some extra staff very soon, as the number of HCT staffers leaving and shouting 'Foul!' rises to epic proportions.

Too true pal, since this week's exam clusterfuck yet again gives us 72 hours to grade papers despite being rostered on for 3-4 hours per day proctoring and senior proctoring duties. I don't have no contract yet and sure as shit I am looking around me at colleagues who are so fucked up with stress that they are arguing with each other over the small grits. I wish I was at an outta town college where the shit from this VC don't smell so bad. Getting a lawyer to help me out when that contract don't arrive before summer is gonna help big time. Thanks man!

This is the only place in the world where you enter initially at a higher post (eg senior officer for staff or lecturer for faculty ) and leave at much lower post (administration assistant or simply as instructor) but doing more work and responsibilities. Contract does not mean anything, HR can call you to sign amendments to your contract at anytime. Latest for faculty is education benefits now slashed by half from 120000 per year to only 60000 capped at 30000 per child.

With a slash in the allowance to result in reduced cash income, in contrast to the existing valid contract. Is that legal?

Contract doesn't mean anything. Exactly 1 minute before work end for the day, HR send email asking to collect contract amendment letter. Benefits such as education either halved or totally removed. Original contract term supposed to end in 2019 suddenly will end in 2018 or worst end of the month. Many support staff now find themselves demoted to lowest ranks such from L3 to L1 as administrative assistant. Some find themselves reassign to another college in another Emirates... Faculty and staff now struggling to arrange moving their families and finding new schools for their children. HCT Sucks is too lenient, it's top management is pure EVIL. You don't do this to people who comes all the way from other nations and treat them like trash. God forbids, if just one of the oppressed staff/faculty raises his hand and ask for divine retribution then this nation is finished and will be cursed.

Breaking an existing contract is haram !!! How can this behavior be allowed to continue unnoticed by the community?? Why or why doesn't someone say something about this in a Ramadan majlis somewhere?

Evil is right. A single mother of three from DMC died of a heart attack shortly after receiving the new amendment. Moves like this break up families or worse, like this. Leaving everything until the last minute so teachers have no choice is an indication that they know exactly what they are doing to teachers. Instead of wasting money on adding so many levels of management and "advisors" who make precisely zero difference on the ground, why not be honest with people. Oh yeah, that would require a level of respect teachers don't deserve. I forgot that.

There's supposed to be 6 months notice period before contract ends of renewal or non-renewal of contract. Some folks basically found out last Thursday that they have until end of July to leave Hct or UAE if they can't find a job within these 2 months. It's totally heartless to expect people to uproot themselves and their families within 2 months. It's cruel to had had given some staff a contract renewal in January only to rescind and now telling them that they have to leave in July. And for those left behind, the prospect of having to cover the duties of those terminated is not something anyone look forward to next academic year. Pity those who will find themselves starting September having to leave for work at 5am in the morning because they now have to travel almost 200km to their new campus because they can't afford to rent another apartment for themselves and another one for their family living in another Emirate because benefits had been cut and its too late to search for schools for the kids and new house and move. Perhaps Hala is the lucky one among us (she's the faculty that passed away) and to think HCT announced her death via email almost 1 hour after office hours. Evil indeed.

The new 'contract' letters are out. Again, they are offer letters that refer to the policies and procedures as an extension of the specifics in the offer letter. Again, they have failed in their promises to provide proper employment contracts. Is there any integrity in HR? Pirate Zak and his crew are full of bullshit. They eat it, they breathe it out, it comes out through their pores like sweat. There is no difference between right and wrong for them, and they are proud of that. They consider it good work.

I have not seen the new offer letters but I've heard about them. Many of those who recieved them found them acceptable. Most likely do to external legal pressures, they now start the contract period in July. This is because all along they were supposed to pay full salary to exiting employees up to their contract anniversary i.e. The end of August for most teachers, if they finished their employment at the end of the academic year. They weren't. HR gave full salary through June and the basic salary as a 'gift' for July. According to the law they should have paid full salary to their August contract anniversary. So, full salary for July and August. Isn't the Islamic penalty for stealing the loss of a hand?

For employees who are not under new 'offer letter' that HR tells itself is a contract, so they can sleep at night and not dream of hand loss and the fires of eternal punishment, but under the current 'offer letter' contract, it is advisable that you resign at the end of the academic year and claim full salary for July and August. Anything less is against the law and can be reported to the Federal Authority of Human Resources, the HCT legal department, and that lawyer SO knows about.

I have a comment about the longer June 5 posting by ananymous.

I have some very good news for those who got and signed an offer letter earlier this year and had it rescinded. According to the law, such an employee can claim full salary and benefits for the contract period they were offered. Surprise! Bet you didn't know that. They offered it in a legal document they call a contract and you signed and accepted it. They are obligated. All these employees need is a good lawyer who knows how to win such a case. You sign a POA giving the lawyer the authority to represent you, pay his fee, leave the UAE after giving the lawyer all the documents he needs, and wait for the lawyer to get your money.

This is all true. All you need is some balls and a lawyer who will fight for you. The problem is that most HCT employees become cuckold and cowered by HCT and would rather leave hct and get it all over with. HCT does lose lawsuits filed by employees. I personally know of two who sued Hct over end of service payouts and both if them won! Maybe that lawyer SO knows about will suffice.

My last words are: GET THE WORD OUT!

This knowledge is useless unless it becomes common knowledge. It is also useless to wingeing hct employees. Right wingers?

I have talked to the lawyer of the previous HCT who has been winning his cases against HCT. He won his absconding case (after the ex employee refused to sign an end of service settlement offer he did not agree with HCT reported him as absconding) so now he can file a case for damages. He also won his recent end of service settlement case. He will get everything he was demanding. The lawyer told me that those teachers who recently received notices that their contracts would not be renewed must receive full salary for the six month period of time following that notification as severance. He wants to meet with those employees who have been victimized by HCT so he can get the money they are owed. If they want to return to their home countries they can commission the lawyer to manage their case in their absence. So, in a nutshell, employees should not be getting end of service only but severance as well based on their basic plus allowances. He said that perhaps employees lack the spirit to make a case and get the money that the legal system and laws say they should get.
